CWA 1104/GSEU CONTRACT PAYBILL
NYS ASSEMBLY ADOPTS CRUCIAL CONTRACT LEGISLATION
Wednesday, July 07, 2010 12 Noon


Our paybill has successfully received a message of necessity and has successfully
moved through the New York State Assembly. Sponsored by Assembly Member Deborah
Glick and cosponsored by Peter Abate, the bill has been adopted and moved out
into the Senate for approval. All legislation must be adopted by both houses
of the legislature before going back to the Governor for adoption. So as is the
typical process for legislation, the Assembly has referred their bill to the
Senate Rules Committee to begin the Senate's ratification process.

At this hour, we continue to work for a Senate number to be attached and canvas
legislators who would vote on this paybill. We continue to lay the groundwork
for movement on this paybill even before the Governor calls the legislature into
session next.

CWA 1104/GSEU CONTRACT PAYBILL MOVES OUT OF DOB

In the midst of the Governor's budget juggernaut, the Union has successfully
advocated that the Division of Budget for New York State release the paybill
necessary to fund the contract settlement which CWA 1104 members negotiated
and ratified in 2010.

Placing the State's obligation to fulfill the promises, now entirely overdue,
during the height of budgetary distractions in New York's Statehouse is a
major accomplishment!

Keep the faith! And please check back for additional updates as the Union now
advocates for the attachment of a "message of necessity" to speed up New York
State Legislature's standard bill "aging" process.

URGENT UPDATE
EVP MESSAGE ON STATE SHUTDOWNS

The NY State Senate and Assembly HAS acted to stop Gov. Paterson's proposed
shutdown of some NYS Governmental Agencies. The 11th such weekly budget
extender, this budget provides the needed State appropriations to fund State
operations and includes some additional "riders" which would typically be
contained within the State's annual fiscal budget appropriation bill. As for
next week and the Statehouse's opprobrium, the Union questions the Governor's
authority to order shutdowns. We will continue to assess the State's actions
and their impact on our membership.

URGENT UPDATE
EVP MESSAGE ON STATE SHUTDOWNS

The NY State Senate began it's deliberations to act to avoid a shutdown of
some NYS Governmental Agencies. The Senate convened at 12 Noon today while
the NY Assembly is scheduled to meet at 2PM today.

The Union finds the Governor's choice to shutdown State Government both
irresponsible and unnecessary. The Union continues to work to determine if
a shutdown would affect paychecks due on June 24, 2010 for work conducted on
May 28-June 10 of this year.

URGENT UPDATE
EVP MESSAGE ON FURLOUGHS
20 MAY 2010


The Union continues to work against the proposed furloughs.
We support the Restraining Order against the furloughs.
We agree with the New York State Senate that Governor Paterson's furloughs are
"contrary to the law and public policy of this state"
and that "it is not reasonable or fiscally necessary to impose furloughs on
unionized state employees in violation of their existing collective bargaining agreements."

The Union has reason to believe
that, should the State seek to implement a furlough, the Employer may contact members
directly to assign furlough dates. Contact the Union immediately if the employer
attempts to direct you not to come to work. Contact the Union immediately if the employer attempts to direct you to work for no pay.

UNION MEMBERS SHOULD NOT SIGN ANY DOCUMENT REGARDING FURLOUGHS.
If the employer requires administrators to provide furlough letters to employees,
we would ask that those administrators also choose not to sign any such document;
although, obviously, they may feel compelled to do so.

Paybill for Agreement 5 in Division of Budget

The Employer's final edits on Paybill are work their way through the Division of Budget without red flags or impediments. The Union is following every step of the process and watching every penny like a hawk. Should the paybill to enact the 2007-2009 Agreement hit any delays, we will need Membership help to move the process along. Please check back for additional updates.

Health Care Negotiations: Settled

The American Aribitration Association (AAA) has certified CWA Local 1104/GSEU's approval of the new 2007-2009 Agreement penned in January of this year. Today's ratification vote cements the deal between the parties and intiates the State of New York's ratification process. Meanwhile, the Union has requested that talks for a sucessor Agreement begin right away.
